AFFIDAVIT
STATE OF FLORIDA )
COUNTY OF PINELLAS )

BEFORE ME the undersigned authority personally appeared CARLA SAUER IYER, R.N., who being first duly sworn, deposes and says:

1. My name is Carla Sauer Iyer. I am over the age of eighteen and make this statement of my own personal knowledge.

2. I am a registered nurse in the State of Florida, having been licensed continuously in Florida from 1997 to the present. Prior to that I was a Licensed Practical Nurse for about four years.

3. I was employed at Palm Garden of Largo Convalescent Center in Largo, Florida from April of 1995 to July 1996, while Terri Schiavo was a patient there.

4. It was clear to me at Palm Gardens that all decisions regarding Terri Schiavo were made by Michael Schiavo, with no allowance made for any discussion, debate or normal professional judgment. My initial training there consisted solely of the instruction “Do what Michael Schiavo tells you or you will be terminated.” This struck me as extremely odd.

5. I was very disturbed by the decision making protocol, as no allowance whatsoever was made for professional responsibility. The atmosphere throughout the facility was dominated by Mr. Schiavo’s intimidation. Everyone there, with the exception of several people who seemed to be close to Michael, was intimidated by him. Michael Schiavo always had an overbearing attitude, yelling numerous times such things as “This is my order and you’re going to follow it.” He is very large and uses menacing body language, such as standing too close to you, getting right in your face and practically shouting.

6. To the best of my recollection, rehabilitation had been ordered for Terri, but I never saw any being done or had any reason at all to believe that there was ever any rehab of Terri done at Palm Gardens while I was there. I became concerned because nothing was being done for Terri at all, no antibiotics, no tests, no range of motion therapy, no stimulation, no nothing. Michael said again and again that Terri should NOT get any rehab, that there should be no range of motion whatsoever, or anything else. I and a CNA named Roxy would give Terri range of motion anyway. One time I put a wash cloth in Terri’s hand to keep her fingers from curling together, and Michael saw it and made me take it out, saying that was therapy.

7. Terri’s medical condition was systematically distorted and misrepresented. When I worked with her, she was alert and oriented. Terri spoke on a regular basis while in my presence, saying such things as “mommy,” and “help me.” “Help me” was, in fact, one of her most frequent utterances. I heard her say it hundreds of times. Terri would try to say the word “pain” when she was in discomfort, but it came out more like “pay.” She didn’t say the “n” sound very well. During her menses she would indicate her discomfort by saying “pay” and moving her arms toward her lower abdominal area. Other ways that she would indicate that she was in pain included pursing her lips, grimacing, thrashing in bed, curling her toes or moving her legs around. She would let you know when she had a bowel movement by flipping up the covers and pulling on her diaper.

8. When I came into her room and said “Hi, Terri”, she would always recognize my voice and her name, and would turn her head all the way toward me, saying “Haaaiiiii” sort of, as she did. I recognized this as a “hi”, which is very close to what it sounded like, the whole sound being only a second or two long. When I told her humorous stories about my life or something I read in the paper, Terri would chuckle, sometimes more a giggle or laugh. She would move her whole body, upper and lower. Her legs would sometimes be off the bed, and need to be repositioned. I made numerous entries into the nursing notes in her chart, stating verbatim what she said and her various behaviors, but by my next on-duty shift, the notes would be deleted from her chart. Every time I made a positive entry about any responsiveness of Terri’s, someone would remove it after my shift ended. Michael always demanded to see her chart as soon as he arrived, and would take it in her room with him. I documented Terri’s rehab potential well, writing whole pages about Terri’s responsiveness, but they would always be deleted by the next time I saw her chart. The reason I wrote so much was that everybody else seemed to be afraid to make positive entries for fear of their jobs, but I felt very strongly that a nurses job was to accurately record everything we see and hear that bears on a patients condition and their family. I upheld the Nurses Practice Act, and if it cost me my job, I was willing to accept that.

9. Throughout my time at Palm Gardens, Michael Schiavo was focused on Terri’s death. Michael would say “When is she going to die?,” “Has she died yet?” and “When is that bitch gonna die?” These statements were common knowledge at Palm Gardens, as he would make them casually in passing, without regard even for who he was talking to, as long as it was a staff member. Other statements which I recall him making include “Can’t you do anything to accelerate her death - won’t she ever die?” When she wouldn’t die, Michael would be furious. Michael was also adamant that the family should not be given information. He made numerous statements such as “Make sure the parents aren’t contacted.” I recorded Michael’s statements word for word in Terri’s chart, but these entries were also deleted after the end of my shift. Standing orders were that the family wasn’t to be contacted, in fact, there was a large sign in the front of her chart that said under no circumstances was her family to be called, call Michael immediately, but I would call them, anyway, because I thought they should know about their daughter.

10. Any time Terri would be sick, like with a UTI or fluid buildup in her lungs, colds, pneumonia, Michael would be visibly excited, thrilled even, hoping that she would die. He would call me, as I was the nurse supervisor on the floor, and ask for every little detail about her temperature, blood pressure, etc., and would call back frequently asking if she was dead yet. He would blurt out “I’m going to be rich!,” and would talk about all the things he would buy when Terri died, which included a new car, a new boat, and going to Europe, among other things.

11. When Michael visited Terri, he always came alone and always had the door closed and locked while he was with Terri. He would typically be there about twenty minutes or so. When he left Terri would would be trembling, crying hysterically, and would be very pale and have cold sweats. It looked to me like Terri was having a hypoglycemic reaction, so I’d check her blood sugar. The glucometer reading would be so low it was below the range where it would register an actual number reading. I would put dextrose in Terri’s mouth to counteract it. This happened about five times on my shift as I recall. Normally Terri’s blood sugar levels were very stable due to the uniformity of her diet through tube feeding. It is my belief that Michael injected Terri with Regular insulin, which is very fast acting.

12. The longer I was employed at Palm Gardens the more concerned I became about patient care, both relating to Terri Schiavo, for the reasons I’ve said, and other patients, too. There was an LPN named Carolyn Adams, known as “Andy” Adams who was a particular concern. An unusual number of patients seemed to die on her shift, but she was completely unconcerned, making statements such as “They are old - let them die.” I couldn’t believe her attitude or the fact that it didn’t seem to attract any attention. She made many comments about Terri being a waste of money, that she should die. She said it was costing Michael a lot of money to keep her alive, and that he complained about it constantly (I heard him complain about it all the time, too.) Both Michael and Adams said that she would be worth more to him if she were dead. I ultimately called the police relative to this situation, and was terminated the next day. Other reasons were cited, but I was convinced it was because of my “rocking the boat.”

13. Ms. Adams was one of the people who did not seem to be intimidated by Michael. In fact, they seemed to be very close, and Adams would do whatever Michael told her. Michael sometimes called Adams at night and spoke at length. I was not able to hear the content of these phone calls, but I knew it was him talking to her because she would tell me afterward and relay orders from him.

14. While at Palm Gardens, I became fearful for my personal safety. This was due to Michael’s constant intimidation, including his menacing body language, vocal tone and mannerisms.

15. I have contacted the Schindler family because I just couldn’t stand by and let Terri die without the truth being known.

FURTHER AFFIANT SAYETH NAUGHT.

Michael Schiavo's Former Girlfriend Speaks:
Excerpts From Cynthia Shook's May 8, 2001 Deposition given in fear

From: http://hyscience.typepad.com/

In a previous Hyscience post, Carole Lieberman, M.D., M.P.H., Psychiatrist and expert medical witness, and  the author of the book, Bad Boys: Why We Love Them, How to Live with Them and When to Leave Them, was quoted as saying, "I have studied men who exhibit pathology in their relationships with women. Profiles of the twelve different types of bad boys are explained. Michael Schiavo fits the profile, described in the book as the Prince of Darkness (see chapter 13). O.J. Simpson was cited as a classic example of this type, and there are indeed similarities between the two men. It is especially significant to note that O.J. flew into a homicidal rage when he realized that Nicole was totally abandoning him, as is characteristic of these impulsive men who most dread being abandoned by their woman. Similarly, Michael Schiavo was likely to have known that Terri had begun making plans to divorce him, since she had told a coworker and family member. Stalking is characteristic of this type of man, as well. And a girlfriend of Michael’s, Cindy, accused him of stalking her in 2001."

This is the story of "Cindy," and the deposition that she had to be forced to give, out of her fear of Michael Schiavo. Terri was also afraid of Michael, but of course Michael has been hard at work to make sure that she can't give a deposition as Cindy has!

In late 1991, 1½ years after Terri’s collapse, Michael Schiavo became involved in an intimate relationship with Cindy Shook. The romance continued for approximately one year. It can be documented that the two spent a weekend at the Don Caesar hotel in St. Petersburg Beach and they also contacted a Century 21 Realtor on the premise of purchasing a home.

In May of 1992, at the apex of the romance, Schiavo had Terri’s 2 pet cats euthanized to clear the way for his moving in with Cindy and her pet dog.

In the summer of 1992, Schiavo moved into his parent’s home. We can speculate with reasonable accuracy, it was at the instructions of his attorney, since the living arrangement would be contrary to Schiavo’s "loving husband" image they were projecting for the upcoming November 1992 malpractice trial.

In April 2001, Cindy Shook (married name Brasher) was interviewed by an investigator working in Terri’s behalf. Unwilling to come forward because of her immense fear of Schiavo, Cindy had to be subpoenaed and was then subsequently deposed on May 8, 2001 to try and learn more regarding her intimate knowledge of Michael Schiavo’s character traits.

Excerpts; May 8, 2001 Deposition:

Cindy Shook describing Schiavo’s possessiveness.

"he’s very jealous. He stalked me at my…at where I worked after I stopped dating…when he would get mad at me he would tell me, I would rather be laying in bed in the nursing home with her than with you. I mean he can be the most incredibly mean person"

When asked if she were afraid that Michael would physically harm her or if he would harm children.

"I am concerned about retaliation because I have a child -I have children and a husband. I know him, I know what he told me I said he could be a very mean person."

She spoke of how Schiavo stalked her for close to a year after the breakup and that she received repeated phone calls.

"He came on the floor looking for me several times. I felt it was out of character for him to get a job as an orderly at the hospital That was concerning to me. When he would come up to the floor looking for her she was not scared the first time but later was scared.

In town I would look up when I was driving…not at my work- she would look up in the rear view mirror and there would be Michael Schiavo. I would look up and he would be behind me in traffic. It continued for several months after he didn’t work at the hospital. She would change lanes, try to make a turn and he would do the same. He did this about ten times.

One time he was behind me in traffic he got next to me in a two-lane going the same way, and he changed lanes basically right on top of where I was at, and I had to swerve not to be hit. I had to swerve off the road. Michael ran me off the road. I considered it as stalking, dangerous and guessed potentially life threatening."

Cindy thought about getting a restraining order. She talked to an off duty police officer in her building

They discussed marriage. She said Schiavo asked what would you do if I asked you to marry me. He never discussed getting a divorce.

Cindy said Schiavo got angry when asked questions about Terri saying:

"this had destroyed his life and he was being robed of a normal life."

Regarding Terri’s care, according to Cindy Shook, Michael Schiavo said,

"How the hell should I know we never spoke about this, my God I was only 25 years old. How the hell should I know? We were young. We never spoke of this."

THEY NEVER SPOKE OF THIS! Yet now Michael claims that Terri's wish was to die of starvation and dehydration, and the infamous Judge George Greer rubber stamps it. Why?

A case for Criminal Investigation of Michael Schiavo:

1) Nurses’ testimony: Heidi Law, Carla Sauer-Iyer, Carolyn Johnson have been ignored and dismissed without hearing; each testified that Michael was abusive to Terri and may have attempted to kill her by insulin injection and attempts to induce pneumonia by turning the thermostat in her room to 64 degrees.

2) Michael Baden, top forensic pathologist in country and interviewed on Fox News National Television broadcast October 25, 2003 on Terri’s bone scan and injuries states that:

            a) Terri’s injuries are not consistent with a heart attack; no cardiac evidence to support it
b) Extremely rare for potassium imbalance on woman her age and in her good health
c) Injuries are consistent with severe trauma possibly caused by a beating
            d) The injuries in medical records warrant an immediate investigation

3) Dr. William Hammesfahr, Nobel prize nominee and neurologist testified that Terri’s neck injuries are consistent with only one type of injury: that of strangulation.

4) Terri’s doctor, Dr. Gambone resigned; he had previously testified Terri would die within a few days of starvation/dehydration.  Terri has an obvious will to live.

5) Michael has enlisted the services of a new doctor, Stanton Tripodis, who has 5 malpractice suits against him.  Clearly, Michael is attempting to provide sub-standard care for his wife.

Case no. 97007946C1 filed 11-25-97
Case no. 94003739C1 filed 6-27-94
Case no. 95000873C1 filed 2-14-95
Case no. 96001434C1 filed 3-6-96
Case no. 98002289C1 filed 4-7-98

6) Michael is committing adultery by living with another woman who has already born one child with another on the way, thereby creating an obvious conflict of interest as guardian.

7) Michael has committed both perjury (2 counts) and insurance fraud by promising to provide care and therapy for his wife in exchange for the court award of 1.2 million dollars in 1993.  No care has ever been provided to Terri.

8) Michael Schiavo has also prevented Terri from undergoing a barium swallow test, a procedure necessary to ascertain the consistency of foods able to be taken by mouth.

9) Co-conspirator George J. Felos combined and conspired with Michael Schiavo to arrange for Terri's "free" stay at Hospice Woodside as part of an "exit protocol" designed to advance Felos' self-perceived messianic mission of "helping" incapacitated people to die by categorizing them as "terminal," warehousing them, and depriving them of therapy and rehabilitation services. (Attorney Felos is Director of Florida Right to Die and has testified that he can ascertain a person’s desire to die by “looking into their eyes and letting their spirit speak directly to him”)

10) Investigate Insurance company established in Jan 2001 at the home of Michael Schiavo and his girlfriend/fiancee Jody Centonze. (Jerger and Centonze Insurnace Agency Inc.) Michael is listed on the Board of Directors for the corporation.  Note: Insurance is deliberately misspelled in the State of Florida Corporate filing, possibly to avoid investigation.

11) Michael continues to deny Terri the right to receive Holy Communion as part of her Catholic and civil right.

The Murder of
Terri "Schiavo"
 Schindler

In this writers opinion it is a disgrace that we as a nation of men and women that 70% call themselves Christians can even be debating this current issue. This is not a free choice issue, this is not a right to die issue. This is a situation where a man with 1.3 million dollars to gain gets to make the decision to allow the starvation of his wife. Terri "Schiavo" Schindler is in her current situation under suspicious circumstances involving, once again, the man who has 1.3 million dollars to gain from her starvation death.

This is also not a case of a woman in a coma. Terri "Schiavo" Schindler recognizes and reacts to people and can maintain her life without extraordinary measures taken to keep her alive...except she needs to be fed with a feeding tube at meal times.

The Judge called Greer has even disallowed any attempt to feed Terri naturally after his order to not allow the use of a feeding tube. This Judge has also disallowed any neurological tests to be conducted that would serve to contradict his "finding" that Terri is in fact in a vegetative state. The Judge clearly, on the record, made an error than lead him to inaccurately rule that being starved and dehydrated to death is Terris's wish. This Judge has allowed the "guardian" to deprive Terri of sunlight, visitors, physical therapy, contact with other residents of the hospice and even the simple task of bushing her teeth...all denied...all ok with the law-breaking Judge in Florida.

And where is the Governor of Florida? he has said he will do everything he can to help Terri within the law. The last time Governor Bush tried to intervene, based on a flawed legislative action, a Florida Supreme Court called it an unconstitutional violation of the separation of powers.

I am generally against executive orders but, in this case the Governor is within his DUTY to issue an executive order sending the Florida Department of Law Enforcement (FDLE) www.fdle.state.fl.us to the Hospice in Pinellas Park, where Terri lives, to prevent her starvation, effectively placing her in protective custody.

Here is the Governor of Florida, Jeb Bush, contact info:

E-mail: "Jeb Bush" jeb@jeb.org
E-mail: "Governor Jeb Bush" Jeb.Bush@MyFlorida.com
E-mail: "Governor Jeb Bush" fl_governor@eog.state.fl.us
Office Ph: Jeb Bush (850) 488-4441 FAX: 850-487-0801

Ask him yourself why he will not uphold his Oath of Office and enforce the Florida Statutes that Judge Greer is violating.

A bone scan conducted on Terri a year after her collapse showed evidence of physical trauma and possible abuse -- leading some to speculate that Terri may have collapsed because she was abused by her now-estranged husband Michael.

“After a thorough review of Terri Shiavo’s case and seeking the opinion of legal counsel, I have concluded that Terri Schiavo is most certainly a victim," said Ted Hires, president and founder of the Justice Coalition www.justicecoalition.org

"There is a very real possibility that an act of domestic violence caused Terri's present condition. The public has a right to know the truth regarding these criminal allegations and until they are investigated, we will not know the answers," Hires added.

So, why is this Judge allowed to facilitate a possible crime? If your child shows up to school with a bruise, the parents are investigated. If you fail to adequately care for your pets, food, water, exercise, ect.. those pets are taken away and you are fined and perhaps jailed.

The circumstances that put Terri in this position need to be fully investigated as does her, so called, husband who lives with another woman and has fathered children by her.

Did Mr. Schiavo know this woman before this "accident" with his wife? Why has he refused to allow any therapy to be given to his wife? Why hasn't he allowed her teeth brushed or sunlight into her room or her own parents to visit for eight months? I want to know, why does Judge Greer want to know?

And then we have Pinellas Park. City officials are blocking off areas in front of the hospice where Terri Schiavo is being confined and where her execution is planned to commence this Friday and local businesses intend to charge $100.00 for parking.

I suggest you all go to this link: http://www.pinellas-park.com/Events/parkevents.asp and contact every participant in "Piranna" Park's "events" and let them know what kind of city they are whooping it up with.

Here are some City of Pinellas Park official contacts...Let them know what you think of their "city."

John Stemberger, the president and general counsel of the Florida Family Council based in Orlando, said at a vigil in Tallahassee Florida (the capital) "We have a governor who will do everything necessary to save Terri," he said.

Contact the Governor and hold him to this statement.

"The House is creating a bill to intervene. Stemberger also said. The bill referred to could affect thousands of individuals in hospitals, hospices and nursing homes. The bill (HB 701) by Rep. Dennis Baxley, R-Ocala, reflects the wishes of House Speaker Allan Bense and Senate President Tom Lee not to pass another bill tailored only to the circumstances of Terri Schiavo.

"Terri's Law," hurriedly passed in fall 2003, gave Gov. Jeb Bush the power to have Schiavo's feeding tube reinserted after it had been removed based on a court order. The Florida Supreme Court later overturned the law, and Bense and Lee said they prefer to take a more deliberative, broader approach to such highly emotional life-and-death cases.

"I certainly hope that whatever error I make is on the side of allowing someone to live rather than to die," Baxley said last week.

We need to understand something else Stemberger said that is being lied about in the mainstream death loving media, Terri "Schiavo is not brain-dead, comatose or in a persistent vegetative state."

"She can laugh, cry, interact," he said. "She is not on artificial life support. She is fed from a tube. There is nothing dignified about death by dehydration or starvation."

Col. Bo Gritz is currently en-route to Pinellas Park, Florida.

We will update as new information is available.

Col. Gritz Will Arrive In Pinellas Park Later Today

Press Release

16 March 2005

TRUE GRIT(Z) RIDES AGAIN: FILES CITIZEN’S ARREST IN SHIAVO CASE

Former Green Beret Commander Bo Gritz is charging-in once again.  The 66 year-old retired Army Lt. Colonel with his wife, Judy, drove straight through from their Southern Nevada home to Pinellas Park, Florida in their own effort to rescue Terri Schindler-Shiavo.  In his typically unconventional fashion, Gritz is arresting Pinellas Circuit Judge George Greer and Terri Schiavo’s estranged husband, Michael Schiavo, plus anyone else who would aid or abet in removing Terri’s feeding tube.

Bo and Judy arrived this evening, after furnishing a notarized “Citizen’s Arrest Warrant” to Governor Jeb Bush and Florida Attorney General Charlie Crist.  Gritz intends on “papering” State and Federal enforcement offices with his warrant on Thursday, one day before Judge Greer has ordered the denial of food and water to Terri Schiavo.  Gritz says the “arrest” is meant to allow officials additional options as the Florida State Executive and Legislative Branches maneuver to secure Terri Schiavo from starvation.  “It’s just another arrow in the quiver which may help pro-Terri forces to counter Judge Greer’s death-order,” says Gritz.

The “Gritz-effect” remains to be seen, but he successfully used the arrest-tool against federal law enforcement in August 1992 when he intervened in the siege at Ruby Ridge, Idaho and brought what was left of the Randy Weaver family down the hill without further bloodshed.  Sammy, the 14 year-old Weaver boy, was killed along with his mother, Vicki, and U.S. Marshal William Degan.  Randy Weaver and another man, Kevin Harris, were wounded by police gun-fire.  Gritz secured the services of renowned defense lawyer Gerry Spence, and the U.S. Department of Justice paid the Weavers $3.2-million in an out-of-court settlement.  Harris was awarded more than $300,000.

Gritz was also present during the longest FBI-siege at the Montana Freemen compound, and helped in the failed-search for Olympic bombing suspect Eric Rudolph -- due for prosecution in Birmingham this month.

Gritz says while he doesn’t want to “cause trouble,”he gets involved when it appears Americans are in needless life-and-death situations with the law.  Citing his officer’s oath of allegiance to “defend the Constitution against all enemies foreign and domestic,” Gritz says while he doesn’t know Terri Schiavo personally, she nevertheless represents an American in danger of citizen-rights abuse, and he feels an obligation to act while she remains alive.  Says Gritz: “Amer-I-cans will always fight for freedom.   Millions of our military place their life on the line to keep tyranny away from our shores.”  He acknowledges and supports the broad-front of Americans who have for years stood-up in saving the life of Terri Schiavo.  Besides a “Terri-Bill” under consideration in the U.S. Congress, the Florida Legislature votes Friday on a modified-measure to keep Terri’s life-support in place.  A previous Florida Bill was ruled un-Constitutional barring further intervention by Governor Bush.  “We all do what we can.  Most people wisely don’t arrest important officials, it can be non-habit forming.  It’s my contribution, as I see it,” says Gritz.

While threatened with arrest at Ruby Ridge and Jordon, Montana, when the smoke-cleared, the much decorated war hero instead walked away with FBI letters of appreciation.  Time and events will soon tell if his presence is thus appreciated in Florida.

A copy of the Gritz Warrant language is attached.

CITIZEN’S ARREST NOTICE
I, James G. “Bo” Gritz, a private citizen, being an American by birth in Enid, Oklahoma, on 18 January 1939, and possessing personal knowledge (reasonable cause) that certain individuals and agencies in and around Pinellas Park, Florida have committed, or will soon commit, specific felony violation of U.S. and Florida State laws, do hereby issue and publish this Citizen’s Arrest Notice requesting government agencies responsible for enforcement, including the Pinellas County Sheriff, Florida Attorney General, State Police, FBI, district attorneys and local police departments arrest the identified person(s) for crimes already committed and restrain them from committing further violations identified in this document.

The focus of this action is to secure the personal safety of Theresa “Terri” Marie Schindler-Schiavo, a natural-born U.S. Citizen currently being held in the Woodside Hospice (727-541-4199) at 6774 102nd Avenue N in Pinellas Park, FL 33782-2909 (Scott Kistler, Vice President of Operations, 727-586-4432).  Terri is paralyzed and in need of care by the Woodside staff – specifically the provision of nourishment and hydration at meal times through a feeding tube.
The specific threat is the wrongful withholding of nourishment from Terri Schiavo beginning at 1:00 p.m. local-time on 18 March 2005 with the specific purpose of her death through starvation and dehydration, as ordered by Circuit Judge George W. Greer (727-464-3933) in the Probate Division of the Circuit Court for Pinellas County, Florida at 2:50 p.m. on 25 February 2005; to be executed by Michael Schiavo (Marrie Ct, Clearwater, FL).  This is a felony conspiracy to cause the wrongful death of an innocent person.  The conspiracy will become a homicide if carried through to completion.

With the exception of the feeding tube at meal time, Terri Schiavo is on no other form of life support-system.  She is not in a comma – she opens and moves her eyes; she is aware, recognizes and reacts to people and other stimuli.  She is paralyzed, but more than 17 physicians and medical specialists have signed affidavits believing her condition will improve with proper therapy.  Nobel Prize nominee Dr. William Hammesfahr has examined Terri and states her injury is a type of stroke that he treats everyday with success.  Terri’s parents, Robert and Mary Schindler are prepared to assume responsibility for continued care of their daughter.  The American people, the U.S. Congress, Florida Legislature, Governor Jeb Bush, Florida Department of Children and Families, the Vatican, numerous public interest groups, and luminary Americans are making public their adamant interest sustaining Terri’s life.

As an American, Terri Schindler-Schiavo is protected under both U.S. Constitutional Laws and Florida Statutes which have been over-ridden by Judge George Greer.  The 8th Amendment forbids cruel and unusual punishment.  Not even  the most heinous criminals are starved to death!  The 14th Amendment protects her human rights as an American.

Florida Statute 744.3215 (Rights of Persons Determined Incapacitated) forbids depriving Terri of food and water, a felony.

Florida Statute 765.404 requires the diagnosis of “persistent vegetative state” be determined as “permanent” prior to withdrawal of life prolonging means.  Judge Greer has refused any further definitive tests (MRI) to ascertain Terri’s current status.

Florida Statute 765.309 prevents mercy killing and assisted suicide.

Florida Statute 765.404 calls for clear and convincing evidence of a ward’s intent concerning life and death medical decisions.  Terri is a Catholic (suicide and assisted termination not an option); Judge Grer ruled-out pro-life testimony and accepted instead Michael Schivo’s self-serving hearsay that he had heard Terri refer to ceasing life-support on one occasion (violation of FL Statute 90.602).

This Citizen’s Arrest Warrant becomes null and void upon transfer of guardianship for Terri Schindler-Schiavo to her mother and father, or the Florida Department of Children & Families, prior to 1:00 p.m. on 18 March 2005.

As the plaintiff, I will physically be present in Pinellas Park at the Woodside Hospice.  I am causing this complaint to be widely distributed so appropriate officials are made aware and may act to prevent this cruel death.  As previously stated: The sole purpose of this document and resulting action(s) is to safeguard a helpless Terri Schindler-Schiavo.  Any action that accomplishes this objective satisfies this Citizen’s Arrest Notice.

Sworn to and Certified before a Notary Public on this date
